poinket is operated by poinket.com (“poinket”, “we”, “us”), based in Florida, United States. You can reach us at [email protected].

• poinket is currently a test build. It is free to download and to use, and the charms in the free library are free to use.
• The app is still in development and may have bugs or change without notice. We provide it as is, without any promise that it will be error-free or always available.
• Early builds are not yet code signed, so Windows or macOS may show a warning before opening them. We publish a VirusTotal scan link next to each download so you can check the file yourself.
• You may use the app for personal and commercial use on your own computers, but you may not resell it, copy it as your own, or reverse engineer it except where the law allows.
• The app contacts our server to check for charm library updates and sends an anonymous install ID as described in our Privacy Policy.

A custom charm is a one-of-a-kind charm made for you. The process works like this:

• You send your idea through the request form. A request is not an order, and we may decline a request.
• We email you to talk it through and agree on the design. The price of a finished charm is $20.
• We send you a draft. You review it and can ask for changes.
• Once you approve the draft, we send a payment link. You pay only after you have approved.
• When payment is received we finish your charm and send you a personal code. You redeem it in the poinket app to add the charm to your library.

The price of a finished custom charm is $20 USD. The price is shown before you pay, and you pay only after you approve your draft. Any taxes that apply are handled by our payment provider at checkout.

Revisions are free. If the draft is not quite right, tell us what to change and we will update it. If your finished charm does not match what you approved, or does not work in the app, we will fix it at no cost. We may decline revisions that change the idea into a different one, and may then quote that as a new order.

You do not pay until you have approved a draft. Because each custom charm is made specifically for you, all sales are final once you have approved the draft and paid, and we do not offer refunds after that point. Free revisions remain available as described above.

If something goes wrong with your order, for example you are charged twice or we are unable to deliver your charm, email [email protected] and we will make it right, including a refund where appropriate. Nothing in these terms limits any rights you have under the law where you live.

• You keep ownership of the ideas and any reference material you send us. You confirm you have the right to share it with us, and that it does not infringe anyone else’s rights.
• Please do not request charms that copy trademarked characters or logos, or that are hateful, sexual or otherwise harmful. We may decline those requests.
• Once your order is complete, you may use your custom charm in the poinket app, including on streams and videos. poinket keeps ownership of the app and the underlying code.
• Each custom charm has its own personal code. You may share the code with friends, but you may not resell the charm or the code.
• We may show finished custom charms in the free library or on our site as examples. If you would rather we did not, tell us when you order.

If you suggest a free charm, you give us permission to use the idea. We are not obliged to build it, and we do not owe you payment if we do.

Please do not misuse the app or the website. That includes:

• Trying to break, overload or gain unauthorized access to our systems.
• Using the request forms to send spam or illegal content.
• Distributing modified copies of the app in a way that suggests we made or approved them.

To the extent the law allows, poinket is not liable for indirect or consequential losses, or for losses caused by using a test build. Our total liability for any claim relating to the app or the website is limited to the amount you paid us for the order the claim relates to, or zero for the free app.

poinket.com is based in Florida, United States. These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute that we cannot resolve by talking it through will be brought in the state or federal courts located in Florida, and you and we both consent to those courts. If you are a consumer, nothing here removes protections that the law where you live says cannot be waived.

We may update these terms from time to time. We will change the date at the top when we do. Orders you have already paid for are covered by the terms in place when you paid.
